Applicants seek to condone delay of 2025 days caused in preferring first appeal for enhancement of the compensation. For the reasons stated in the application, the delay needs to be condoned.

Application is contested by the respondents. It is submitted that the explanation is not sufficient and convincing. 3.

The contents of the application are not controverted. There is nothing on record to infer any oblique motive on the part of the

2 48 ca 15771.22 applicants in preferring the first appeal belatedly. By imposing certain conditions, it is desirable to condone the delay. 4.

The civil application is allowed. The delay stands condoned on condition that applicants shall not be entitled for interest and statutory benefits for the delayed period of 2025 days. The civil application is disposed of. Office shall register the first appeal.
