Heard the learned Advocates for the parties.

This application is filed for withdrawal of the amount deposited by the Respondent-Insurance Company in the office of this Court in the First Appeal.

It is pointed out that, after the death of earning member of the family, the present applicants who happen to be wife and daughter of the deceased filed claim petition. The mother of the deceased also filed another claim petition. The learned Tribunal has allowed both the claim

( 2 ) petitions and directed to pay compensation of Rs.15,05,000/- in total. Out of which Rs.8,05,000/- is granted to present applicant No.1. Rs.4,00,000/- is granted to applicant No.2. Remaining amount is directed to be given to the mother-in-law of applicant No.1. 4.

It is informed that the mother-in-law is already permitted to withdraw the amount of her share. This application is filed for withdrawal of the share of present applicants. 5.

Considering that the applicant No.1 is widowed lady who has to maintain applicant No.2 child, this Court is inclined to allow the application. Hence, the following order:

ORDER

(i) Application is partly allowed.

(ii) The applicant No.1 is permitted to withdraw the amount of Rs.4 lakhs alongwith accrued interest deposited in the office of this Court on furnishing usual undertaking.

(iii) Further amount of Rs.2 lakhs alongwith accrued interest is permitted to be withdrawn on furnishing solvent surety/security to the

( 3 ) satisfaction of the learned Registrar (Judicial) of this Court. (iv) The amount to the extent of applicant No.2 be kept in fixed deposit. However, the quarterly interest shall be credited to the account of applicant No.1.
