The Original Application was dismissed along with Misc. Application No. 481 of 2016. The order impugned herein has been passed by the learned Single Judge of the Maharashtra Administrative Tribunal, Aurangabad dismissing the application for condonation of delay along with Original Application (ST) No. 1995 of 2016 for want of prosecution.

We have heard the learned Advocate for the petitioner. The learned Advocate for the petitioner informs that the Division Bench was not available there and his counter-part informed him that the

(2) 923- W. P. No. 255-2019.odt matter would therefore, not be listed. The matter was however taken up by the learned Single Member and observed that no steps are taken by the applicant for service of notices upon the respondents and the matter was dismissed.

For the reasons sated in the petition, the order impugned herein dated 28.07.2018 passed in Misc. Application No. 481 of 2016 is set aside and the matter is remitted back to the Maharashtra Administrative Tribunal, Aurangabad for decision of the matter on its own merits.

The learned Advocate for the petitioner undertakes to take steps for service upon the respondents in the matter before the Maharashtra Administrative Tribunal within two weeks, after the matters are restored on the board.
