The applicants apprehend their arrest in connection with Crime No. 225/2021 registered with Dhule Taluka Police Station for the offences punishable under section307, 452, 323, 504 and 506 read with 34 of IPC.

Heard the learned advocate for the applicants and learned Additional Public Prosecutor for respondent/State. Perused the investigation papers.

The allegations in the First Information Report are mainly against accused No. 1 and 2. Applicants are implicated in Bhagyawant Punde

{2} 924-ABA-1494-2022 the crime as accused No. 3 and 4. Overt act is attributed to accused No. 1 and 2 only. There are vague and general allegations against applicants that they have facilitated the crime. No specific overt act of assault is attributed to the applicants.

The applicants were granted interim protection and they have co-operated in the investigation. In that view of the matter, custodial interrogation of the applicants is not warranted in the facts of the present case. The application is therefore allowed in terms of interim order dated 3rd November, 2022. 5.

Till filing of charge sheet, the applicants shall attend the concerned police station as and when called by the investigating officer. The applicants shall not tamper the prosecution evidence.
