The applicants apprehend their arrest in connection with Crime No. 123/2012 registered with Pishor, Taluka- Kannad Police Station for the offences punishable under section 13(1), (c), (d) read with section 13(2) of the Prevention of Corruption Act, 1988 and under Section 120-B, 409, 420, 468 and 471 of Indian Penal Code.

Heard the learned advocate for the applicants and learned Additional Public Prosecutor for State. Perused the investigation papers.

Charge sheet in the present crime is already filed on 26.09.2017. The offence pertains to documents, which are already seized by the investigating officer. Therefore, custodial detention and/or interrogation of the applicants is not necessary in the present crime. In that view of the matter, the application deserves to be allowed.

The application is therefore allowed.

In the event of arrest of applicants in connection with Crime No. 123/2012 registered with Pishor, Taluka- Kannad Police Station for the offences punishable under section 13(1), (c), (d) read with section 13(2) of the Prevention of Corruption Act, 1988 and under Section 120-B, 409, 420, 468 and 471 of Indian Penal Code, they shall be released on executing personal bond of Rs. 15,000 each, with one surety each in the like amount. The applicants shall attend the concerned police station as and when called by the investigating officer. The applicants shall not tamper the prosecution evidence.
