IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 4233 OF 2012 Proposed Jijamata Majoor Sahakari Sanshta Maryadit Satra & Others PETITIONERS

VERSUS

The Assistant Registrar & others RESPONDENTS WITH WRIT PETITION NO. 10531 OF 2012 Proposed Bodhraj Majoor Sahakari Sanshta Maryadit Diksal & Others PETITIONERS

VERSUS

The Assistant Registrar & others RESPONDENTS .......

Mr. P. S. Chavan, Advocate for the petitioners Mr. S. K. Kadam, AGP for respondent State .......

[CORAM : SUNIL P. DESHMUKH, J.] DATE : 10 th AUGUST, 2015 ORDER :

1.

In view of the minutes of the meeting dated 23rd April, 2013, though the petitioners dispute recording of the same, it is apparent that the petitioners' societies have been refused to be accommodated for non availability of sufficient work. In such a case, a proper challenge will have to be posed to the same with reference to the contentions, which now are being advanced by

{2} wp4233-12 the petitioners.

2.

The petitioners' proposals had been returned by the Assistant Registrar, Co-operative Societies, for the reason that district level information had not been supplied and the Joint Registrar, Co-operative Societies, had rejected the revision against said return of proposals for the reason that the meeting of divisional level committee had not been held while proposing petitioners' names.

3.

During pendency of writ petitions, minutes of the meeting were recorded. In view of the same, the petitions have been rendered infructuous. The petitioners have to pose a fresh challenge in respect of their proposals having regard to the minutes of the meeting.

4.

Petitions, as such stand disposed of with liberty to the petitioners to make proper approach against the minutes of the meeting and the decision with reference to the same. [SUNIL P. DESHMUKH, J.] drp/wp4233-12
