The Petitioner is aggrieved by the interlocutory order dated 15.09.2023 passed by the learned Maharashtra Administrative Tribunal in Misc. Application No.399/2023 in Original Application No.621/2023 by which, the ad-interim relief granted earlier has been vacated and the matter is listed for further hearing/ final hearing.

We have considered the submissions of the learned Senior Advocate for the Petitioner and the learned Advocate for Respondent No.3.

The interim protection granted to the Petitioner is in existence till today. The proceedings before the learned Tribunal are posted on 12.10.2023. All the parties are agreeable to address the Tribunal by way of a final hearing on 12.10.2023. 4.

In view of the above, this Writ Petition is disposed off with the following directions:- (a) The ad-interim order passed by the Tribunal on 17.07.2023, shall continue till 10.11.2023 or till the Learned Tribunal decides the OA.

(b) All the litigating parties would address the Tribunal by way of final hearing on 12.10.2023. Written notes of submissions would be kept ready and would be tendered on the same date.

(c) We request the learned Tribunal to endeavour to deliver a judgment in the pending proceedings, before 10.11.2023, if possible.

(d) We make it clear that none of the litigating parties shall seek an adjournment on 12.10.2023.
