Heard learned AGP appearing for applicants/State. Applicants pray for grant of permission to bring on record Lrs of deceased respondent Himmatlal Lilachand Desai, who died on 27.04.2021. There is delay of 1170 days in filing this application. However, it is specifically stated in paragraph No. 4 of the application that applicants were not aware about death of Himmatlal and they came to know same only when information was given to them by respondents Advocate.

Considering reasons as stated in application delay is properly explained. Hence application is allowed in terms of prayer Clauses (B to D). 3.

Amendment be carried out within two weeks from today. 4.
