VERSUS

1.

The State Of Maharashtra Through Its Secretary, 2.

The Scheduled Tribe Certificate Verification Committee. ...

Advocate for the Petitioner : Mr. Sunil Mahadevappa Vibhute AGP for Respondents: Mr. P. S. Patil ...

CORAM

: R. G. AVACHAT & ABASAHEB D. SHINDE, JJ.

Dated : SEPTEMBER 29, 2025 PER COURT : - 1.

The petitioners claim to have belonged to "Mannervarlu", Scheduled Tribe. Their tribe certificates have not been validated by the respondent - Scrutiny Committee. They are therefore before us. 2.

The learned Counsel for the petitioners would submit that there are not less than 10 validity certificates granted in favour of the blood relations of the petitioners. According to him some of them have been granted validity certificates by this Court. He therefore urged for allowing the writ petition.

1 of

1 WP 11976-2025 3.

The learned AGP would on the other hand submit that except Sunil Narayan Wallamwad other validity holders have not been shown in the genealogy submitted by the petitioners before the Scrutiny Committee. The petitioners could therefore not rely on those validity certificates since relationship between them and the petitioners yet to be proved. The learned AGP however concedes that the validity holder Sunil has been shown in the genealogy submitted by the petitioners and there is no dispute between their relationship.

4.

We have considered the submissions advanced, perused the order impugned. Herein, Sunil Narayan Wallamwad, one of the blood relations of the petitioners, has admittedly been granted validity certificate on the directions of this Court passed in WP No.3740 of 2024. We have therefore to allow the petition.

ORDER

1 WP 11976-2025 to issue a caste validity certificate to the petitioners, confirming that he belongs to 'Mannervarlu', Scheduled Tribe, within six weeks from the date of receipt of this order. C) The validity certificate of the petitioner shall be subject to the outcome of verification to be undertaken by the Caste Scrutiny Committee of validity holders on whom the petitioners are relying.
