The petitioner who was already issued with a tribe certificate but not in the prescribed form, has applied again to the Competent Authority online seeking a caste certificate in the prescribed form 'C'. Unmindful of the request, by the impugned order, he has rejected the application as if he was called upon to decide and issue a tribe certificate for the first time. 2.

When the petitioner was already having a tribe certificate and it was merely a matter of changing the form and that too, because of the fault of his own office in stead of noticing this anomaly, the competent authority/respondent no. 2 was bold enough to reject the application overlooking everything. 3.

Writ Petition is allowed. The impugned order is quashed and set aside.

The petitioner is stated to have already surrendered the original caste certificate which was issued to him in the incorrect form, the respondent no. 2 - authority shall immediately issue the tribe certificate in prescribed form 'C' within a period of one week.
