IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD CIVIL APPLICATION NO. 15772 OF 2022 IN FIRST APPEAL ST. NO. 29466 OF 2022 Late Vishwanath Pandurang Shrikhande and Muktabai Vishwanath Shrikhande Applicant

Versus

Bapu Ramdas Badgujar & others Respondents Mr. M. M. Bhokarikar, advocate for the Applicant Mr. A. I. Deshmukh, advocate for Respondent No.1. Mr. C. D. Biradar, advocate for Respondent No.2. CORAM : SANDIPKUMAR C. MORE, J.

DATE : 17th January, 2023.

PC :

Heard rival submissions.

The applicant is seeking condonation of delay of only 1205 days which appears to be caused due to her financial crisis.

The learned Counsel for the respondents no.1 and 2 strongly opposed the application on the ground that the delay is not properly explained.

{2} ca15772.22.odt Considering the statutory right of the applicant, the delay of 1205 days stands condoned subject to the condition that the applicant shall not claim any interest for the aforesaid period of delay.

Appeal be placed for admission after removal of office objections, if any.

Civil Application is disposed of.
