PER COURT :- 1.
Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is apprehending arrest in connection with FIR No.0223/2024, dated 06/04/2024, registered at Shrirampur Police Station, District Ahmednagar, for the offences punishable under sections 15, 3 of the Environment Protection Act, 1986 and under Section 379 of the Indian Penal Code.

This Court granted interim protection to the applicant by order dated 12/11/2024 for the reasons stated therein. Today, the learned APP submits that the vehicle taken into possession, bearing No. MH-21/D9509, is not registered with the RTO. It is further stated that the chassis number and engine number are tampered.

Per contra, the learned Counsel appearing for the applicant submits that the vehicle does not belong to the applicant, and he has no 1 of
933 ABA 1725-2024 connection with the vehicle in question. It is also submitted that the applicant has not been identified by any member of the raiding party or the panch witnesses, despite his attendance at the police station in pursuance of the order dated 12/11/2024.

In view of the above, the interim protection granted on 12/11/2024 stands confirmed on the following terms : - i] In the event the applicant/s is/are arrested in connection with FIR No.0223/2024, dated 06/04/2024, registered at Shrirampur Police Station, District Ahmednagar, for the offences punishable under sections 15, 3 of the Environment Protection Act, 1986 and under Section 379 of the Indian Penal Code, he shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court.
ii] The applicant shall attend the police station as and when called by the police.
iii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iv] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court. 6.
In the event, the applicant violates any of the conditions specified 2 of
933 ABA 1725-2024 in this order, it shall be liable to be cancelled. 7.
It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 8.
The application stands disposed of.
