The learned counsel for the State Election Commission submits that the nomination of the petitioner has been rejected on the grounds of non-submission of the certificate indicating that a toilet is constructed and is being used, evidence of pending caste validity claim not submitted and the electoral roll number of the proposer and the seconder do not match with the Voters' List.

Learned counsel for the petitioner, therefore, seeks leave to withdraw this petition, with liberty to avail of a remedy as is permissible in law in connection with the ensuing elections. 3.
