It is pointed out that application under section 13(1)(ib) of Hindu Marriage Act, 1955, claiming divorce, was dealt with by the Civil Judge, Senior Division, Latur. Appeal against order lyes to the District Court. It would be open for the appellant to tender appeal to the District Court. If the appellant tenders appeal within a period of four weeks from today, the District Court, while considering application seeking condonation of delay that may be presented by the appellant, shall take into consideration the time spent for erroneously prosecuting the remedy before this Court. Appeal stands disposed of as withdrawn.
