Since the office objections were not removed, the writ petition was dismissed for default. 153 days delay was caused in filing the present application. It seems that the petitioner was not obedient even in following the Court's order. Hence, in such a situation, penalty should be imposed upon the petitioner. For the reasons mentioned in the civil application for delay, the delay is condoned.

Application is allowed as prayed for the restoration subject to the costs of Rs.2000/- to be paid to the Government Dispensary High Court, High Court Premises, Aurangabad within three (3) weeks from today.
