The respondents strenuously oppose this application and in the alternative pray for heavy costs to be donated to Advocates' Bar Association of Bombay High Court, Bench at Aurangabad. 3.

Considering the above and reasons set out, the Civil Application is allowed. The L.Rs. of deceased sole appellant shall be brought on record on/or before 9.2.2018 and the delay is condoned subject to the condition of costs of Rs.2,000/- which the applicant shall deposit with Advocates' Bar Association of Bombay High Court, Bench at Aurangabad, on or before 2.2.2018.
