The applicant apprehends his arrest in connection with Crime No. 797 of 2022 registered with Newasa Police Station, District Ahmednagar for the offence punishable under sections 304 of the Indian Penal Code and section 135 of the Indian Electricity Act.

It is alleged the in FIR that due to negligence on the part of the applicant, his employee suffered electric shock and expired.

Heard the learned advocate for the applicant and the learned Additional Public Prosecutor for the respondent - State. Perused the investigation papers.

The spot panchanama and material collected during the investigation show that the necessary recovery is already done by the investigating agency. The incident has taken place 02/09/2022 and the investigation is almost complete. 5.

While granting interim protection, the applicant was asked to attend the concerned police station and co-operate in the investigation, which the applicant has done. In that view of the matter, custodial detention of the applicant, at this stage, is not warranted in the facts of the present case. 6.

The application is allowed by confirming the interim order.

Till filing of charge-sheet, applicant shall attend the concerned police station as and when called by investigating officer. The applicant shall not tamper with the prosecution evidence.
