The present application is filed seeking review of the judgment and order dated 23rd June, 2010, passed by this Court in Writ Petition No. 307/1993.

By the order under review, this Court modified the order passed by the Industrial Court and granted relief of permanency from the date of completion of one year of service by each of workmen, instead of from the date of filing of complaint, granted by the Industrial Court. While passing the order in favour of workmen, this Court has relied upon Single Bhagyawant Punde

{2} 923-RA-150-2013 Bench decision of this Court in Burroughs Welcome (I) Ltd., Mumbai v. D.H. Ghosle and others [2001 (2) Mh.L.J. 54] and full bench decision of this Court in Gangadhar Balgopal Nair v. Voltas Limited & another [2007 (1) Bom. C.R. 1].

Having heard the learned advocate for the applicant at length, this Court is of the view that the applicant in the present application has failed to make out a case for review of the judgment and order dated 23rd June, 2010 as contemplated under Order 47, Rule 1 of Code of Civil Procedure.
