I have briefly heard the learned Advocate for the petitioner and respondent No.1. An interlocutory order dated 22/09/2017 is under challenge. It is, however, informed that RCS No.85/2008, filed by the petitioner, has been dismissed on 06/03/2018 and a Regular Civil Appeal No.53/2018 has been filed before the Appellate Court. 2.

Considering the above, I find that this petition is rendered infructuous and the same is, therefore, disposed of. Needless to state, all contentions of the litigating sides are kept open including the grievance of the petitioner with regard to the impugned order dated 22/09/2017 which I have not considered on its merits while disposing of this petition.
