Heard learned counsel for both sides. Perused the application.

The applicant - original claimant is permitted to withdraw 50% of the amount deposited by the respondent-Acquiring Body on furnishing undertaking to the satisfaction of Registrar (Judicial of this Court and rest of 25% of the amount on furnishing Solvent Surety and remaining 25% of the amount be deposited in the Fixed Deposit Receipts in any Nationalized Bank for a period of two years or final adjudication of the appeal on merits, whichever is earlier. The applicant-claimant to furnish undertaking to the effect that he would refund the amount so withdrawn, in case, any adverse situation arises in the appeal after adjudication of the matter.

The civil application is allowed in aforesaid terms and stands disposed of.
