On 11.11.2022, we had passed the following order :- "1. A marathon hearing in this matter concluded at 06:10 PM. After we expressed our disinclination, the learned Advocate for the petitioner sought time till Tuesday (15.11.2022) to take instructions from the petitioner.

2. As such, list this petition on 15.11.2022 (Tuesday) in the passing orders category."

The learned Advocate for the petitioner submits on instructions that the petitioner desires to withdraw this petition. 3.

The learned Advocate representing the University submits that khs/Nov.2022/11203

- 2 - the nomination form of the petitioner contains such details which are factually untrue and clearly indicate an attempt on the part of either the Principal or Management to mislead the University Authorities. He harps upon the fact that the petitioner joined as a Principal on 01.08.2022 and was granted an approval vide communication dated 03.08.2022 issued by the Deputy Registrar (Academic Section) of the University. As such, on the cut off date viz. 11.07.2022 (online applications) and 18.07.2022 (for submitting hard copies and payment of fees), the petitioner was never a Principal. He further prays for heavy costs.

Considering the above and the fact that the petitioner is unconditionally withdrawing this petition with an oral apology, that we intend to give a '

quietus'

to this matter.

This petition is dismissed, as withdrawn.
