Mr.Jayabhar, learned counsel submits that though the possession of the petitioners' land was taken prior to notification U/s 4 of the Land Acquisition Act, the petitioners are not paid the rental compensation. The application is

2 W.P.No.5342/16 made to the Collector who is also the Special Land Acquisition Officer for grant of rental compensation. The same is not yet decided.

We have heard learned A.G.P. also.

The record does not show that the application has been made seeking rental compensation to the competent authority.

The petitioners may make the application to the competent authority seeking rental compensation. In case such an application is made by the petitioners, the competent authority shall decide the same on its own merits in accordance with law, preferably within eight months from the receipt of application after hearing all parties concerned.

The Writ Petition is disposed of. No costs.
