BENCH AT AURANGABAD WRIT PETITION NO.12038 OF 2022 BALAJI VYANKATRAO PATIL
VERSUS
THE STATE OF MAHARASHTRA THROUGH THE SECRETARY AND ANOTHER ....
Mr. Anand V. Patil - Indrale, Advocate for petitioner Mr. A. S. Shinde, AGP for respondents - State ....
CORAM : MANGESH S. PATIL AND Y. G. KHOBRAGADE, JJ.
DATE : 01.12.2022 PER COURT :- Heard.
2.
The petitioner is approaching this Court perhaps because of his inability to pursue the execution for recovery of the amount of the land acquisition compensation in the execution proceeding preferred before the executing Court and still is unable to get the award executed by exhausting all the remedies under Order 21 of the Code of Civil Procedure.
(( 2 )) 937-WP-12038-2022 3.
We are of the view that Order 21 of the Code of Civil Procedure gives enough powers to the executing Courts to see that the execution is successful.
4.
Learned advocate for the petitioner, on instructions, seeks leave to withdraw the writ petition.
5.
Leave is granted.
6.
The writ petition is disposed of as withdrawn. [ Y. G. KHOBRAGADE, J. ] [ MANGESH S. PATIL, J. ] SMS
