CORAM: S.S.SHINDE & SMT.VIBHA KANKANWADI, JJ. Dated: March 25, 2019 ...
The writ petition is pending for considerable time. However, none appears for the petitioner. Even after Court notice served upon the petitioner, neither petitioner appeared personally nor arrangement was made to engage an Advocate to represent him.
2.
Upon perusal of the prayers in the Petition, it appears that there is innocuous prayer in the Petition in as much as direction is sought to Respondent
9734.11WP No.1 - Scrutiny Committee to decide the tribe claim of the petitioner within stipulated period.
3.
In that view of the matter, in case Respondent No.1 has not yet decided the tribe claim of the petitioner, the same shall be decided as early as possible, and preferably within four months from today, however, subject to full co-operation of the petitioner.
We make it clear that, we have not expressed an opinion on the merits of the claim of the petitioner, and it is for Respondent No.1 - Committee to take an appropriate decision.
4.
With the above observations, the petition is disposed of.
