The Applicant has filed the present application, thereby praying for grant of bail in connection with Crime No.533/2025 dated 20.08.2025 registered at Udgir Rural Rural Police Station, Taluka Udgir, District Latur for the offences punishable under Sections 118(2), 115(2), 352, 351(2), 189(2), 190, 191(2)(3) of Bharatiya Nyaya Sanhita, 2023.

The submission of the Counsel for the Applicant is that the other co-accused who were arrested alongwith the present Applicant, namely Navnath Suryawanshi and Rajaram Suryawanshi, are released by the learned Lower Court, while the application of the present Applicant is rejected on the very same ground that the Applicant has assaulted the injured persons, Baliram and Archana. 2 912.BA-1934-2025.doc accused Navnath and Rajaram has taken a specific note that the Applicant had in addition assaulted a female member of the family and only on that ground, has rejected the regular bail of the present Applicant.

I have heard the learned Counsel for the Applicant as well as the learned APP who has produced before me the investigation papers. After perusal of the injury certificate of Rahul, Baliram and Archana, it could be seen that the injuries caused by the Applicant on Baliram and Archana are reported to be simple injuries, whereas the injury caused by the other accused Navnath, who has been released on bail, upon the complainant Rahul, is reported to be a grievous injury to the nasal bone, which is one of the vital parts of the body. Since the other two co-accused, who have caused grievous injuries, are already on anticipatory bail, I am inclined to exercise discretion under Section 482 of the B.N.S. to release the Applicant in the present crime on the ground of parity. Hence the following order :
ORDER
(i) The Applicant - Parshuram Uttam Suryawanshi, be released on bail on furnishing Personal Bond of Rs.50,000/- (Rupees Fifty Thousands) in connection with Crime No.533/2025 registered with Udgir Rural Rural Police Station, Taluka Udgir, District Latur for the offences punishable under Sections 118(2), 115(2), 352, 351(2), 189(2), 190, 191(2)(3) of Bharatiya Nyaya Sanhita, 2023, subject to following conditions :
3 912.BA-1934-2025.doc (a) Applicant shall not directly and indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; (b) Applicant shall not commit a similar or any other kind of offence in future.
(c) Applicant shall not enter the village Limbgaon, Tq. Udgir, Dist. Latur till framing of charge.
(d) Applicant shall attend the police station Udgir Rural once a month on the first Saturday between 10.00 a.m. and 11.00 a.m. till filing of charge-sheet.
