Learned counsel for the petitioner, on instructions, seeks leave to withdraw this writ petition with liberty to produce before the trial court the relevant document / information pertaining to the application submitted by the respondents-defendants at the time of opening of bank account with Jalgaon District Central Co-operative Bank Limited. In case, the said information is received from the bank, further, liberty to issue notice to admit document to respondents-defendants.

In view of above, writ petition is disposed of as withdrawn with liberty as aforesaid.

In the event if the respondents-defendants deny the contents of the application submitted before the Bank at the time of opening of the account, the petitioner would be at liberty to file an application for witness summons.
