ORDER :

The petition is filed for giving directions to the respondents and particularly respondent No. 3 to make re-audit of the petitioner No. 1 - Housing Society. Both the sides are heard.

In the reply affidavit, it is contended that Special Auditor Shri. S.K. Gaike is already appointed, but he could not complete the audit as he could not get some record which is seized by the police and which is produced in the case in criminal Court in Aurangabad bearing R.C.C.No. 1674/2012. 3.

It appears that Shri. Gaike has made application in the Court of J.M.F.C. also, but his

WP No. 3476/14 application was not allowed and the application of accused was allowed. As the Joint Registrar is supervising authority and that office has power to inspect the record, the record needs to be supplied to the Special Auditor. The charges for getting copies are to be deposited in advance by the petitioner and the petitioner undertakes to deposit the charges on or before 23.3.2017. After depositing of the charges by the petitioner - institution, the copies of record supplied by the Criminal Court which Shri. Gaike wants are to be supplied to Shri. Gaike, Special Auditor.

If Shri. Gaike is not available now, respondent No. 3 is to appoint another auditor in the place of Shri. Gaike. Audit work is to be completed within six months from that date. With these observations, the petition is disposed of.

Authenticated copy is allowed to both the sides.
