The learned advocate for the applicant submitted that in the application for the grant of stay to the conviction order, he has not made any averments regarding receiving the notice to him. Similarly, he failed to annex a copy of the notice with the application. Therefore, he seeks leave to withdraw the application with liberty to file a fresh application, for which the learned APP has given no objection.

In view of this, the application is disposed of as withdrawn with liberty as prayed.
