DATE : 12th November, 2024 Per Court :- We have heard both the sides. The petitioner, who was in the select list at Sr.No.8 for the post of Scavenger to be engaged in the District and Sessions Court, Parbhani, is before us being aggrieved and dissatisfied by the fact that though he had received the selection letter and though all eight seats have been filled in, the last one has been filled in by way of inter-district transfer of the candidate from Amravati district, who was already in employment.

Though it is indeed unfortunate for the petitioner,

*2* 915wp11389o24 the advertisement itself was making it abundantly clear that the wait list was to be prepared only for filling in existing vacancies and the vacancies that would occur in future. It is not that someone who has scored less marks has been appointed in preference to the petitioner. The vacancy incidentally was filled in by way of inter-district transfer and more unfortunate for the petitioner that even the life of the wait list/ select list has expired by efflux of time. No writ, as is claimed by the petitioner, can be issued. The Writ Petition is dismissed.
