This petition is misconceived in as much as the representation of the petitioner dated 23.08.2017 (Exh.D) (Page Nos. 25 and 26) was addressed to the Secretary Rural Development Department, Maharashtra State, Mumbai. In fact the immediate authority to take the cognizance of the grievance raised by the petitioner is Chief Executive Officer, Zilla Parishad, Aurangabad. In that view of the matter we are not inclined to entertain this petition. Further we grant liberty to the petitioner to file comprehensive representation to the Chief Executive Officer, Zilla Parishad, Aurangabad. The concerned authority to decide the same on its own merits as expeditiously as possible.

With the above observations the writ petition stands rejected.

While considering the said representation, the order passed by the Divisional Commissioner, Revenue, Aurangabad shall also be taken into consideration.
