Criminal Application No.3129 of 2021 moved for assist to APP stands allowed and disposed of.

Report from learned District Judge-1 and Additional Sessions Judge, Ahmednagar was called in respect of Sessions Case No.298 of 2019. It is stated that the charge has been framed on 13th November 2019. It is stated that Counter case to Sessions Case No.298 of 2019 bearing Sessions Case No.69 of 2020 was received by the said Court on 9th March 2020. It is then stated that since there are counter cases and it is necessary

to record the evidence and pronounce the Judgments simultaneously, at least one year period will be required for completion of the trial.

Therefore, taking into consideration the said report, the learned Advocate for the applicant, on instructions, submits that he would withdraw the present Application with liberty to approach this Court after about one year if the trial does not get concluded. He prays that the directions be given to the trial Court to expedite the trial and complete it within the said period of one year.

In view of the above statement, the Application stands disposed of as withdrawn with liberty to the applicant to approach this Court if the trial does not get over within the period of one year.

Learned District Judge-1 and Additional Sessions Judge, Ahmednagar is directed to expedite the Sessions Case No.298 of 2019. He should complete the recording of evidence and hearing of arguments and should pronounce the Judgment on or before 28th February, 2023.

It is clarified that if the trial does not get over by 28th February 2023, the applicant may approach this Court, thereafter.
