The learned counsel for the appellant/claimant Mr. R.H.Dahat along with representative of the appellant insurance company and Mr. Shaikh Kayyum Najir, learned counsel for respondent No.1 and 2, along with respondent No 1 and 2 are present. 3.

With the assistance of the learned counsels, we have ascertained identification of the appellant and respondent Nos. 1 and

2. They affirm the terms of settlement.

The learned counsel and the parties who are present have placed on record the terms of compromise. Same is taken on record and marked as Exhibit-X for identification.

As per the terms of settlement Exhibit-X, the appellant/ Insurance Company shall receive an amount of Rs. 1,50,000/- (Rupees One Lakh Fifty thousand) out of amount which is already

fa 3239-2021 -2deposited in this Court. The balance amount along with accrued interest shall be permitted to be withdrawn by respondent Nos. 1 and 2.

The appellant shall pay the deficit court fees, if any, within a period of three weeks from today.

7.

The payment of deficite court fees, if any shall be the condition precedent to withdraw the amount.

8.

The first appeal stands disposed of in terms of the settlement Exhibit-X and present minutes of order.
