IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CRIMINAL REVISION APPLICATION NO. 191 OF 2015 The State of Maharashtra ..

Applicant

Versus

Shaikh Chand s/o. Shaikh Naeem & Anr.

..

Respondents Mr. K.S.Patil, A.P.P. for applicant/State.

Mr. A.S.Shejwal, Advocate for respondent Nos. 1 & 2. CORAM : A.V.NIRGUDE, J.

DATED :

01.03.2016 P.C. :- 1.

Heard. This revision application challenges order passed by the learned Special Judge refusing police custody remand. It was held by the learned Judge that police has exhausted statutory period of police custody remand and therefore the request for further police custody remand was refused. I do not see any reason why I should interfere in this order. The provisions of the MCOC Act were not added to the offence and therefore concession given to police of extended police custody remand for accused arrested under the provisions of the MCOC Act is not available. Learned A.P.P. besides informed that permission to add provisions of the MCOC Act is refused and therefore this petition is almost infructuous.
