Nirmala Virbhadra Satamwar Alias Nirmala Uttamrao Totewad v. Virbhadra Vyakantrao Satamwar
904-MCA-224-2018.odt (1)
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 904 MISC.CIVIL APPLICATION NO.224 OF 2018 NIRMALA VIRBHADRA SATAMWAR ALIAS NIRMALA UTTAMRAO TOTEWAD
VERSUS
VIRBHADRA VYAKANTRAO SATAMWAR ...
Advocate for Applicant : Mr. Tapse Ashok R ...
CORAM : ROHIT B. DEO, J.
DATED : 07th FEBRUARY, 2020.
PER COURT:- .
Heard the learned counsel for the applicant. None appears on behalf of the non-applicant who is duly served.
2.
The averments in the application have gone unchallenged.
3.
The applicant-wife is seeking transfer of H.M.P. No.61 of 2018 pending before the learned Civil Judge Senior Division, Mukhed, District Nanded to Civil Judge Senior Division, Beed.
4.
The submission is that the applicant and the nonapplicant married on 11.05.2015 and presently the applicant is residing with her parents at Beed.
5.
The submission of the learned counsel for the
904-MCA-224-2018.odt (2) applicant is that as on 15.10.2018 when this application was filed, the applicant was pregnant and has since then delivered a female child.
6.
Considering that the applicant is to look after the child and it would be extremely inconvenient for her to travel along with the child to Mukhed, In my considered view a case is made out for allowing this application in terms of prayer clause (C) which reads thus:
"C.
The proceeding bearing H.M.P. Petition No.61/2018 pending before the learned Civil Judge, Senior Division, Mukhed to be transferred to Civil Judge, Senior Division, Beed."
