This Court has already passed order on 25.10.2024 indicating that on merit, applicants are entitled for relief. However relief was not granted into applicant No. 3 only for the reason that the objection was raised by the learned counsel for informant that on the basis of false statement about there being practical examination scheduled of this applicant in the college, an order was obtained of temporary bail from this Court.

In order to ascertain the said fact, this Court had called upon the prosecution to record statement of the Principal. Today, statement in writing of the Principal is placed on record to indicate that the practical examination was scheduled between 05.11.2024 to 07.11.2024, however 925-ABA-1737-2024.odt

it was postponed. Applicant No. 3 cannot be held responsible for the postponement to the said examination. Suffice it to state that the relief obtained of temporary bail was not on the basis of statement. Hence application stands allowed by confirming interim order. (R. M.
