Respondent No.2 has filed affidavit-in-reply stating that after he joined the present post on 23rd October 2024, he has conducted 18 hearings in the Money Lending Dispute No. 12 of 2017. However, subsequently, an application was filed by the non-applicant on 28.11.2024 in the said dispute for stay to the proceedings as per Section 10 of the Code of Civil Procedure. He decided the application by order dated 13.01.2025 and rejected the application by refusing the stay. This order was challenged in Writ Petition No. 4440 of 2025 before the learned Single Judge and interim relief staying his order is granted on 4.4.2025. It is submitted that, the dispute was at the stage of final hearing. In view of the stay granted by this Court, he could not proceed further.
