In the present writ petition, the prayers are made seeking directions against the respondents No.1 to 3 to make an inquiry in pursuance to the representation made on 14.9.2010, so also seeks injunction against the respondents No.4 to 6 from interfering in the Administration of Union.

We have heard Mr. Thombre, learned counsel for the petitioner and Mr. Shendurnikar, the learned counsel for respondents No.5, 6. There are rival contentions made by the petitioner and respondents No.4 to 6. The contentious issues are also with regard to the Administration of the Union and its office bearers. It is submitted that the Union is recognized as per the provisions of Maharashtra Civil Services (Conduct) Rules, 1979. 3.

It is also submitted by the learned counsel for respective parties, that it is the Social Justice Department, who looks into the working of the Union.

WP 10374.2010.odt In light of that, it would be appropriate if the parties approached the Social Justice Department for redressal of their grievances. It would not be appropriate to make an investigation into the disputed questions of facts in the present writ petition. 5.

In the result, we pass following order

ORDER

The parties may approach the Social Justice Department, Government of Maharashtra. In case, any representation/application is made by any of the parties, then the Social Justice Department shall consider the same, on its own merits, in accordance with law, Rules, after hearing all the parties concerned, expeditiously and preferably within SIX months from the date of receipt of the application/representation.

Writ Petition is disposed of. No costs.
