Per Court :- The learned counsel for the applicant, upon instructions from his client seeks permission to withdraw the present Criminal Application with prayer for early disposal of the case. [2] The learned Special Judge has observed that, case is fixed for framing of Charge however, the accused are not co operating, therefore, the Charge cannot be framed. The learned counsel for the applicant submitted that, present applicant was/is ready to co operate the court.
2/2 cri.appln. 6407.14..sxw [3] In that view of the matter, the learned Special Judge, Aurangabad is directed to frame the Charge as early as possible and dispose of the case within a period of ONE YEAR from receipt of this order.
[4] It is further made clear that the accused who are released on bail by the learned Special Judge, who are not co operating the learned trial court to frame the charge, the learned trial court should take necessary steps to procure their presence before the court and dispose of the case within the time stipulated. [5] With these observations, Criminal Application is disposed of.
