The appellant Insurance Company is present. Authorized signatory of the Insurance Company Mr. Dinesh Shankar Bankar is present with Advocate Ms. Anagha Rotte for the appellant. Respondent No.1 is the guardian of respondent Nos. 2 and 3. Respondent No.5 Bhugaji Ramaji Khillare is present and Respondent No.4 Smt Kastura Bugaji Khillare is present through Video Conferencing. All the claimants are identified by Advocate Shri. G. B. Pimple representing for the claimants. 3.

Both parties are arrived at compromise and filed compromise pursis which is marked "X" for identification. As per the agreed terms of compromise parties are arrived to settle the claim for an

FA- 2757-2024 -2amount of Rs. 1,43,00,000/- ( One core Forty Three Lakhs Five only) as full and final settlement.

Appellant/ Insurance Company undertakes to deposit the remaining amount within a period of 45 days in this Court and the same be disbursed to the claimants as per the award passed by the learned Motor Accident Claim Tribunal Aurangabad. On depositing the amount, claimants are entitled to receive it without reference of this Court.

First Appeal is disposed of as withdrawn in view of withdrawal pursis. Pending Civil Application also stands disposed of. 6.

Award be drawn up accordingly.

7.

The request of refund of Court fees shall be processed by the office in accordance with law.
