Since the applicant was not prompt enough in attending the matter, the petition was dismissed for default and the applicant now approached after 355 days for restoration and condonation of delay. In such a matter, the Court should avoid casual approach in allowing the application. There must be discipline in attending the matter for timely disposal of the petitions.

Learned Counsel for the applicant expresses his desire to pay costs. However in the interest of the justice and the reasons mentioned in the application, the delay is condoned subject to costs of Rs.5000/- to be paid to the Bar Association, Aurangabad within three weeks from today.
