When confronted with availability of alternate remedy, the learned senior counsel for the petitioner, on instructions, seeks withdrawal of the petition with liberty to file appropriate proceedings with further a request to direct to the concerned Appellate Authority to decide the appeal within stipulated time. 2.

Considering the aforesaid request, it will be appropriate to direct the concerned Appellate Authority to decide the appeal, within a period of four weeks from the presentation of appeal. It is made clear that all the points are kept open. 3.

In light of the aforesaid, the criminal writ petition is disposed of as withdrawn with liberty as prayed for.
