Looking to the allegations that the applicant was found in possession of contraband pan masala and scented tobacco, which stand prohibited under the notification issued by the Commissioner of Food Safety under Section 30 of the Food Safety and Standards Act, and in view of the invocation of Section 328 of the IPC, it is noted that the contraband Gutkha and pan masala have already been seized by the Investigating Officer. The applicant has no criminal antecedents. Nothing further remains to be recovered from him, and he has expressed willingness to co-operate with the investigation and has also undertaken not to indulge in similar offences in future. Considering the nature of allegations and the material placed on record, I am inclined to grant anticipatory bail to the applicant. Hence, the following order :- Jhs/ 1/2

O R D E R

A) In the event of arrest in connection with FIR bearing Crime No. 831/2025, dated 08.09.2025, registered with Police Station Srirampur City, Tq. Shrirampur, Dist. Ahilyanagar, for the offences punishable under Sections 26(2)(iv), 27(3)(d), 27(3) (e), 30(2)(a), 3(1)(zz) of the Food Safety and Standards Act, 2006, the applicant - Amzad Naushad Sayyad shall be released on bail on furnishing PR Bond of Rs. 50,000/-, with one or two sureties in the like amount.

B) The applicant is directed to attend the concerned Investigating Officer on every Monday, between 10:30 a.m. and 01:30 p.m., till framing of the charge and shall co-operate with the investigation.

C) The applicant shall not tamper with the prosecution evidence in any manner. He shall not indulge in any cognizable offence. Any single reported incident involving the applicant shall entitle the prosecution to move for cancellation of bail. D) The applicant shall furnish his residential address, contact number, and copies of his Aadhaar / PAN Cards to the Investigating Officer, and shall also provide the names, addresses, and contact numbers of his close relatives for the purpose of verification.

In view of the above conditions, the Anticipatory Bail Application is disposed of.
