PER COURT :- Perused the order passed by the Trial Court below Exhibit 78 in RCS No.343/2010. The application tendered by the petitioner, original plaintiff seeking appointment of TILR for measuring the property has been turned down by the Trial Court. On perusal of the order, it is noticed that the parties to the litigation have adduced their evidence and the matter was fixed for final arguments and at that stage, the application came to be filed. Even otherwise, considering the interlocutory nature of the order passed by the Trial Court does not call for inference under extraordinary jurisdiction under article 226 of the Constitution of India.
Petition is devoid of any substance and hence stands dismissed.
