By consent, these Writ Petition can be disposed off. 2.

By consent, the petitioner management shall constitute a committee and complete the other formalities to commence with the de novo inquiry, as directed by the University Tribunal, within two months and the petitioner management shall complete the said inquiry in the prescribed period i.e. four months. Learned counsel for the respondent-employee also accepts that in terms of the ratio laid down by the Supreme Court in the case of Vidya Vikas Mandal and Another v. The Education Officer and Another, reported in

915-WP-10676-2017 -2- (2007) 11 SCC 352 the employee could not be re-instated. The petitioner management to pass appropriate orders with regard to the suspension of the respondent/employee pending enquiry. The order passed by the University Tribunal is modified to the extent as above.
