The application is filed for condonation of delay of 252 days in filing Second Appeal which has been attributed due to miscommunication between the applicants and their lawyer. Though the application is strongly opposed by the learned counsel for the sole respondent on the ground that there are concurrent findings against the applicant, but considering the statutory right of the appellants, the delay of 252 days stands condoned subject to cost of Rs. 500/- (Rupees Five Hundred) to be paid to the Library, Advocates Association of High Court, Bombay, Bench at Aurangabad within two weeks.
