The learned counsel for the appellant seeks leave to correct the middle name of the appellant. Leave is granted. Amendment to be carried out forthwith.

The learned counsel for the appellant/claimant Mr. Amit A. Mukhedkar along with appellant and learned counsel Mr. Mohit R. Deshmukh for the respondent No. 2 along with representative of the respondent No. 2 namely Mr. Yogesh Sonawane are present today.

With the assistance of the learned counsel, we have ascertained identification of the appellant and the respondent No. 2. They affirm the terms of settlement.

The learned counsel and the parties who are present have placed on record the terms of compromise. Same is taken on

2 fa 1448.14 record and marked as Exhibit - X for identification. 5.

As per the terms of settlement Exhibit - X, the respondent No. 2 shall deposit an additional amount of Rs. 3,00,000/- (Rs. Three Lakhs only) towards the full and final settlement between the parties within the stipulated period as agreed between them. The same shall be treated as an undertaking. On depositing the amount, the appellant/claimant is permitted to withdraw the same. The amount already deposited in the M.A.C.T. Nanded is also permitted to be withdrawn by the appellant/claimant with accrued interest if any.

The first appeal stands disposed of in terms of the settlement Exhibit - X and present minutes of order. 7.

The court fees be refunded in view of the settlement, as is permissible in law.

Award be drawn up accordingly.
