Appellant Nos. 1 and 2 and respondent Nos. 1 and 2 are with their Advocates. The respondent No.3 is reported to be dead and died issueless. The death certificate in respect of respondent No.3 is produced alongwith the compromise pursis. The compromise pursis is taken on record and marked as "X" for the purpose of identification. 2.
The learned advocates for the parties submit that the parties have amicably settled the suit subject matter. Parties present admit their respective signatures/thumb impression on compromise pursis and further admit the contents of the compromise pursis are recorded truly and correctly as per the settlement arrived at between the parties. 3.
In view of settlement of the dispute between the appellant Nos. 1 and 2 and respondent Nos. 1 and 2, the appeal is disposed of in terms of compromise pursis filed as "X" for identification. Appeal stands abated as against respondent No.3. Decree be drawn up in terms of the compromise. 4.
In view of disposal of the appeal, civil application does not survive and same stands disposed of in terms of disposal of appeal. [V.L. ACHLIYA] JUDGE.
