The land acquisition award was passed in the name of the father of the petitioners even when he was already dead. It appears that the petitioners have subsequently obtained heir-ship certificate. The petitioners now claim that they are the heirs of the deceased and armed with a heir-ship certificate issued under the Bombay Regulation Act, 1827. They are now seeking that the respondent No.4 should pay the compensation that was to be paid to the predecessor Sahebrao Baburao Ghule.

It appears that the petitioners had merely issued a local notice dated 09.09.2019, but had not submitted any application requesting the S.L.A.O. to disburse the compensation on the basis of heir-ship certificate.

We dispose of the writ petition by permitting the petitioners to submit fresh application before respondent No.4 within two weeks and respondent No.4 shall take decision on the application according to its own merits as early as possible and in any case within a period of eight weeks from the date of receipt of the application.
