In view of our order dated 22.12.2025, learned Advocate for the petitioner has taken the instructions from the husband of the victim i.e. present petitioner and it is stated that he is not willing to take the petitioner for cohabitation. Even it appears that the District Women and Child Development Officer, Parbhani had contacted the present petitioner i.e. husband of the victim and he has given it in writing that he has no relationship with the victim. We do not want to go into the aspect as to whether what is the nature of their relationship, but it appears on record that he is the same person who had filed the FIR as well as the present petition by projecting himself as the husband of the victim. 901-wp-12194-2025.odt remains is that he is not ready to take her for cohabitation. Nobody else is coming forward to take care of the lady. Further, the medical report of the victim i.e. psychological assessment states that she has mild intellectual level. Even as regards her periodical behaviour that has been noted would suggest that some or the other way she is not mentally stable. Under such circumstance, it would be not appropriate to leave her like that or in other words, she should then be leaved from the center where she is presently kept.

Learned AGP had informed that there is an institution by name Government Saraswati Women Shelter Home at Nagpur, where she can be kept and, therefore, we direct District Women and Child Development Officer, Parbhani to shift the victim to the said institution. The said institution should receive the victim and take care of her in view of the State Government policy.
