Heard learned Counsel appearing on behalf of the petitioner. 2.

Learned Counsel for the petitioner submitted that though by an order dated 21st January, 2019, passed by the Division Bench of this Court in Writ Petition No.12668 of 2018, the respondent - Municipal Council was directed to consider the entitlement of the petitioner for pensionary and retiral benefits within a stipulated period of three months, the same is not decided. He then fairly submitted before this Court that the copies of the representations placed on record are not very happily worded and these representations create an impression as if the order is passed by this Court, directing the authorities to release the benefits in favour of the petitioner. It is then submitted by learned Counsel for the petitioner that as the petitioner is a retired Teacher and is not very conversant with the legal formalities, the representations are not very happily worded.

In view of aforesaid peculiar facts, we deem it appropriate to permit the petitioner to approach respondent No.5 - Chief Officer, Municipal Council, Jalna, by submitting a fresh and proper representation within a period of two weeks from today.

In case, such representation is submitted to respondent No.5 - Chief Officer, Municipal Council, Jalna, respondent No.5 to decide the same keeping in mind the order of this Court, dated 21st January, 2019, as expeditiously as possible and not later than three weeks from the date of receipt of the representation.

With the aforesaid directions, the contempt petition is disposed of.
